1. Agreement to Terms
Welcome to ExamStudy.online (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website, https://examstudy.online, and our AI-powered question generation services (collectively, the “Services”).
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.
2. Description of Services
ExamStudy.online provides an AI-powered tool designed to generate educational exam questions, multiple-choice questions (MCQs), and other study materials for various user roles, including teachers, students, and job seekers. Our Services are available through different plans, which may include a free trial and paid “Pro” subscriptions.
3. User Accounts
a) Account Creation: To access certain features of our Services, you must register for an account. When you create an account, you agree to provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in the immediate termination of your account.
b) Account Security: You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
4. User Responsibilities and Conduct
By using our Services, you agree not to:
- Use the Service for any illegal or unauthorized purpose.
- Attempt to reverse engineer, decompile, or otherwise discover the source code of the website or its underlying technology.
- Scrape, data-mine, or use any automated means to access the Services or collect information from it.
- Resell, sublicense, or otherwise commercially exploit the Services or the content generated by it without our express written permission.
- Input any personal, sensitive, or confidential information of any third party into the question generation fields.
5. Subscriptions, Payments, and Refunds
a) Subscriptions: We offer both free trials and paid “Pro” subscriptions. Features and limitations are determined by the plan you select.
b) Payments: All payments for Pro subscriptions are processed securely through our third-party payment processor, WooCommerce. By providing a payment method, you expressly authorize us to charge you for your chosen subscription plan.
c) Billing: Subscriptions are billed on a recurring basis as specified at the time of purchase. You will be billed in advance of each billing cycle.
d) Cancellations and Refunds: You may cancel your Pro subscription at any time. All purchases are generally non-refundable. Any requests for refunds will be considered on a case-by-case basis at our sole discretion.
6. Intellectual Property Rights
a) Our Property: The Services and all of its original content, features, and functionality (including but not limited to all software, text, displays, images, and the design) are and will remain the exclusive property of ExamStudy.online and its licensors.
b) Your Content: The questions and materials generated by you through our Services (“Generated Content”) are provided for your personal, educational, or internal professional use. You are granted a license to use, reproduce, and modify the Generated Content for these purposes (e.g., creating study materials, classroom exams).
c) Restrictions: You may not engage in the mass redistribution, resale, or packaging of the Generated Content as a standalone commercial product without our prior written consent.
7. AI-Generated Content Disclaimer
The content generated by our Services is created by an artificial intelligence model. While we strive to provide high-quality and accurate results, we cannot guarantee the accuracy, completeness, or appropriateness of the Generated Content.
You, the user, are solely responsible for reviewing and validating all Generated Content for accuracy and suitability before using it for any purpose, especially for academic assessments or professional examinations. We are not liable for any errors, inaccuracies, or any damages arising from the use of the Generated Content.
8. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Upon termination, your right to use the Services will cease immediately. If you wish to terminate your account, you may simply discontinue using the Services or contact us to request account deletion.
9. Disclaimer of Warranties and Limitation of Liability
The Services are provided on an “AS IS” and “AS AVAILABLE” basis. We make no warranties, express or implied, regarding the operation of our Services or the information, content, or materials included therein.
In no event shall ExamStudy.online, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Services.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Dhaka, Bangladesh.
11. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
